Adoptable Agreement

By purchasing and owning my designs, you agree to the rules and terms listed below. I am not responsible for any issues caused by the buyer not reading the agreement.

I. General Rules

- Using my art or designs for AI, NFT purposes or to spread hateful and illegal content is strictly prohibited.
- If my Agreement is violated, I have the right to revoke ownership of the adopt.
- Please credit me as @deathlxght when posting my artwork. Other variations such as @/deathlxght or #deathlxght are also acceptable. Tagging is optional.

II. Character Usage & Transfer Policy

- If you resell, trade, gift, or give away a design, You can let me know the new owner if possible. This is optional, but appreciated.
- You may decide the character’s name, gender, species, lore, personality, and other details freely.
- If you resell a design, feel free to tell me! I can help it reach more people by retweeting it.✦ Edits:
- You may use the outfit for your OC.
- You may edit or recolor the design yourself by editing directly on the original image. You can mention that the design has been edited.
- I will not make design changes myself unless an edit fee is paid.
- Simple edits (e.g. eye or skin color) are free.
- Complex edits (e.g. changing the whole palette or major design elements) cost $10-$30 depending on complexity.✦ Resale:
- Designs can only be resold if they were originally bought with money or obtained through a mixed offer that included money.
- Designs received through trades or gifts cannot be resold unless you spend money on commissioned artwork. The resale price cannot exceed the total amount spent.
- Designs cannot be resold for more than their original purchase price unless there are additional commissioned artwork or value-adding work.
- For mixed offers (money + item/service), the money paid cannot exceed the design’s value, and the resale price cannot exceed the original offer amount.✦ Raffle/Giveaway:
- Please do not buy my designs just to immediately raffle or give them away.
- You may raffle or give away a design later, but please inform me first.

III. Personal & Commercial Usage

- Most of my adoptables come with commercial rights included. If you purchased one for Personal Use, you may buy commercial rights later if needed.
- Please contact me to purchase the commercial rights before using the design for profit.✦ Personal Usage includes:
- Social media use, profile pictures, banners, etc.
- Posting/showcasing online with credit.
- Non-profit fan or original projects.
- Personal prints or digital goods that are not sold.✦ Commercial Usage includes:
- Everything under Personal Usage.
- Sponsored content and advertisements.
- Branding & Vtuber branding.
- Monetized fan/original content.
- Digital or physical products for profit.

Terms of Sale

I. Payment Method

- All prices are in USD.
- Payments must be made in USD via PayPal invoices or Ko-fi.
- Priority: Upfront payment > Payment plans > Holds.

II. Payment Plans & Holds

✦ General:
- Down payments are non-refundable.
- If you don’t respond within 5 days after a payment plan or hold deadline, without prior notice, the adoptable will be relisted for sale.
- If you need more time or run into any payment issues, please let me know beforehand!✦ For "Offer to Adopt" Adoptables:
- Payment plans and holds are flexible and may be included in your offer for me to consider.
- A down payment is appreciated but the amount can be discussed.✦ For "Set Price" Adoptables:
- Payment plans and holds can be requested! Please keep in mind that they may or may not be accepted.
- Payment plans and holds duration is flexible, please discuss it with me first!
- An accepted payment plan requires a down payment of any amount.
- No down payment is required for holds.

III. Refund Policy

- Refunds are not allowed. If a chargeback happens, all rights to the adopt will be revoked.

IV. Privacy

- All client information will be kept private by default and will not be shared without the client’s permission.
