Adoptable Agreement

By purchasing and owning my designs, you agree to the rules and terms listed below. I am not responsible for any issues caused by the buyer not reading the agreement.

I. General Rules

- Using my art or designs for AI, NFT purposes or to spread hateful and illegal content is strictly prohibited.
- If my TOS is violated, I have the right to revoke ownership of the adopt and in serious cases, you will be blacklisted from future purchases.
- Please credit me as @deathlxght when posting my artwork. Other variations such as @/deathlxght or #deathlxght are also acceptable. Tagging is optional.

II. Character Usage & Transfer Policy

- If you decide to resell, trade, gift, or give away a design, please let me know who the new owner is if possible. This is not required, but I would appreciate being informed.
- You are free to decide any details for the character (such as name, gender, species, lore, personality, and more).
- If you're posting a resale, feel free to let me know! I can help by retweeting it to reach more people.✦ Edits:
- You can use the outfit for your OC.
- You're free to edit and recolor the design yourself by editing directly on the original artwork. You can note that it has been edited.
- I will not make changes to the design myself unless an edit fee is paid.
- Simple edits, such as changing the eye color or skin tone, are free of charge.
- More complex edits (such as altering the entire color palette, modifying major design elements, or changing shapes) will incur a fee of $10-$30 depending on complexity.✦ Resale:
- Designs may only be resold if they were originally obtained with money or a mixed offer that included money.
- Designs received through trades or as gifts may not be resold. (Exception: If the new owner spends money on additional commissioned artwork for a character obtained through trade or gift, resale is allowed. The resale price must not exceed the total amount spent)
- If a design was obtained through a mixed offer (money + item or service), the money portion must not exceed the design’s value, and the resale price must be equal to or lower than the original offer amount.
- Designs may not be resold for more than their original purchase price. However, additional commissioned pieces of the design, or your own value-adding efforts (such as artworks related to the design), may increase its resale value.✦ Raffle/Giveaway:
- Please do not purchase my designs with the sole intent of immediately using them in a raffle or giveaway. You are welcome to rehome a design through those methods at a later time. Please inform me about it first.

III. Personal & Commercial Usage

- Most of my adoptables come with commercial rights included. If you purchased one for Personal Use, you may buy commercial rights later if needed.
- Please contact me to purchase the commercial rights before using the design for profit.✦ Personal Usage includes:
- Profile pictures, banners, headers, etc., on any social media.
- Posting online with credit.
- Showcasing on live streams.
- Non-profit fan projects (e.g., a fan MV or cover song video).
- Non-profit original creative works (e.g., music videos or song covers).
- Personal prints or digital goods (as long as they are not sold).✦ Commercial Usage includes:
- Everything listed under Personal Usage.
- Sponsored posts or promotions.
- Advertisements (e.g., posters, billboards, etc.).
- Branding & Vtuber branding.
- Monetized fan content (e.g., cover songs on Spotify/YouTube).
- Monetized original creative works (e.g., music videos or song covers).
- Digital or physical items that generate income.

Terms of Service

I. Payment Method

- All prices are in USD.
- Payments must be made in USD via PayPal invoices or Ko-fi.
- Priority: Upfront payment > Payment plans > Holds.

II. Payment Plans & Holds

✦ General:
- Down payments are non-refundable.
- If I do not receive a response from the buyer within 5 days after a payment plan or hold due date, and no prior reason is given, the adoptable will be relisted for sale.✦ Payment Plan & Holds for Auction & Offer Adoptables:
- Payment plans and Holds are available for AB purchases or winning bids/offers of $280 or higher.
- Full payment must be made within 48 hours after the auction ends if no payment plan or hold is arranged.Payment Plan:
- A minimum down payment of $100 is required.
- The remaining balance must be paid within 60 days or by a mutually agreed date.Hold:
- A hold period may not exceed 14 days.
- No down payment is required for holds.
- Full payment is required once the hold period ends.✦ Payment Plan & Holds for Set Price Adoptables:
- A payment plan or Holds may be considered if the adoptable has been listed on my Ko-fi Shop for a long time or if I am in urgent need of funds.
- Requests for payment plans or holds will not be accepted within the first 48 hours of posting.
- Payment plans and holds are subject to approval and are not guaranteed.Payment Plan:
- If accepted, a minimum down payment of 50% is required.
- The remaining balance must be paid within 60 days or by a mutually agreed date.Holds:
- If accepted, no down payment is required for holds.
- A hold period may not exceed 14 days.
- Full payment is required once the hold period ends.

III. Refund Policy

- Refunds are not allowed. If a chargeback happens, all rights to the adopt will be revoked.

IV. Privacy

- All client information will be kept private by default and will not be shared without the client’s permission.
